Lease terms and conditions:

Morning Star Villa – Quinta Estrela da Manhã (hereinafter “Villa”or “Property”or “Premises”) is a luxury self-catering holiday villa located in Impasse das Covas 23, Arco da Calheta, Madeira (Portugal), operating under the licence nr. 36967/AL .

The Owners of the Villa let and the Tenant (above and hereinafter  also “Guest” or “Guests”) takes the Villa together with all relevant fixtures, and fittings and the furniture and effects in the Premises,  under the following terms and conditions:

  1. Check-in time is from h. 15:00 and check-out time is until h. 10:00.
  2. Guests must comply with all House Rules of the Villa during their stay. House rules: 1] Smoking indoors is not permitted. 2] Pets are not permitted. 3] The limit on the maximum number of guests that can be in the Villa is seven. 4] Morning Star Villa is not suitable for children under 12 y.o.  and Guests in age between 12 y.o. and 16 y.o. are not allowed  to use the following Villa’s facilities without adult supervision:  Office pc,  Cinema Room,   Sauna and Gym. 5] Damages and breakages must be reported to the Owners.  6] Guests are liable for the cost to fix damages. 7] Parents or legal guardians are fully responsible for the damages occasioned by their minor child. 8] The use of the fireplace is not permitted.  9] Vehicles should be parked in the Villa’s garage. Vehicles may also be parked on the public road, as long as the access of other vehicles coming to and from the neighbours properties is not impeded. 10] A part of the garden of the Villa along the side facing the ocean, whose entrance is properly interdicted with  poles and chains, is not included in the Lease and therefore Guests and Visitors are not allowed to access to this area. Any unauthorized trespass into this Prohibited Area will be considered as a breach of the Lease Agreement and it will be done at the risk of the intruder. 11] Guests should not dig up, cut, break, remove, or take any  bush, plant or flower of the  12] Guests and Visitors are to dispose of garbage and recycling in the bins allocated in the garbage room, and excess rubbish must be left in public rubbish bins. 13] Whenever Guests are absent from the Property, they should close all windows and doors to maintain security and prevent wind, rain and water damage. Guests are also recommended to close the windows and the doors of the rooms in which they are not staying, in order to prevent  lizards and insects to get inside of the Villa. 14]Guests should read carefully and follow relevant istructions of the “quick users instruction” for appliances, included in the House Book, before using  Garage, Cinema, Gym and Sauna.
  3. Guests can not make any alteration or additions to the Premises and are legally obliged to take all reasonable and proper care of the Property including garden, fixtures, fittings, furniture, pictures and other effects in or around the Property and shall leave them in the same state and condition at the end of the Lease period as found at the beginning.  In the event of any damage during the stay, the Guests are required to notify the Owners.
  4. € 300,00 Cautionary Deposit is required to cover costs resulting from the action or inaction of the Guests  such as (but not limited to): the Property being left in an unreasonable state, loss or non-return of keys, neglect or damage to the Property, damage or loss of contents. The Cautionary Deposit will be refunded by bank transfer within 14 days of Guests departure from the Property less any costs incurred. In the event of damages attributed to the Guests or a member of their party during their stay the Owners shall notify this to the Guests as quickly as reasonably possible together with any evidence. The cost of any remedial action shall be deducted from the Cautionary Deposit and the balance refunded to the Guests. In the event that the cost of rectification for losses or damages caused by the Guests or a member of their party exceeds the Cautionary Deposit held, the Owners shall notify the Guests of any additional amount owing. The Guests are advised that the property Owners reserve the right to pursue recovery of any additional cost over and above the Cautionary Deposit.
  5. Guests shall leave the Property in tidy condition: this includes cleaning all cutlery and crockery and placing all rubbish in appropriate waste or recycling bins.
  6. The Owners can not accept any responsibility or liability for loss of or damage to any of the Guests personal items, belongings or vehicles, however caused. The Owners shall not be under any liability to the Guests or third parties for any accident, damage, loss, injury, expense or inconvenience, which may be suffered, incurred or arise out of or in any way connected with the Lease.
  7. Any dispute, arising out of or in connection with the Lease, shall be resolved in front of CACC-RAM (Centro de Arbitragem de Conflictos de Consumo – Regione Autonoma Madeira). Portuguese law shall apply to the Lease.

 

Prices includes taxes and are intended per each week of stay (7 nights minimum stay required)

Cancellation policy

if cancellation occurs up to 56 days prior to arrival: no penalty will be charged;
if cancellation occurs from 55 to 28 days prior to arrival: 50% of entire amount will be charged;
if cancellation occurs from 27 days prior to arrival:100% of entire amount will be charged.

P.S. Cancellations must be advised by e-mail, cancellations by phone will not be considered valid.
